In Memory Of (IMO) created this policy to inform you of our online practices in maintaining robust privacy protections for you, our users. Our Privacy Policy is designed to help you understand how we collect, use and safeguard personal and confidential information you provide us and to assist you in making informed decisions when using our Service.  For purposes of this Agreement, “Service” refers to IMO’s service easily accessed via our website at https://www.inmemoryof-memorial.org, in which users make charitable contributions in honor of loved ones who have passed. The terms “we,” “us,” and “our” refer to the Company; “You” refers to you, as a user of our Service. By accepting our Privacy Policy and Terms of Use, you consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. 1.  Core Principles

We believe in the spirit of generosity and the sanctity of privacy. As donors who are willing to give in support of bereaving families, your information is kept confidential from the recipient organization to allow you to give freely and without consequence.

With regards to your personal information, our goal is to be fully transparent and accountable for the trust you put in us in helping to facilitate your support for families asking to honor their loved ones through memorial contributions. We do not share or sell your personal or financial information with any person or organization.  We do provide some of your personal information directly to the family to inform them of your support which may include name(s), address and/or email address. 

 

2.    Collection

When you use our service, we collect the following information, and use it only as described below:

2.1. Personal Information. This may include your name, address, email address and phone number. We use this information in the ways you would expect, such as communications with you regarding your donation and communication with the family to ensure they are aware of your support.

2.2. Payment Information. When you make an online donation, it is transmitted via an encrypted connection to our Payment Processor, Stripe. Stripe uses and processes your payment information in accordance with Stripe’s Privacy Policy. We do not store your payment information nor do we have access to your credit or debit card account numbers.

2.3. Communications With Us. When you send us emails or other communications, such as customer support inquiries, we maintain those communications and their contents so that we can resolve your inquiries or otherwise assist you.

2.4. Files You Provide Us. When you use the Services, we store, process and transmit your content (such as your photos) and information related to your content (such as obituary notices). We process and store such files and information in order to provide the Services as described in our Terms of Service.  This content is generally provided to us via our funeral home partners through our online software vendor Jotform whose Privacy Policy may be found here.

2.5. Usage Information. This includes information about your activity on and interaction with the Services, such as your IP address, your device or browser type, the webpage you visited before coming to our sites and identifiers associated with your devices. This information enables us to analyze how the Services are being accessed and used, and to track performance of the Services.

2.6. Location Information. Your devices (depending on your settings) may transmit location information to the Services. We use this information to customize, improve and protect the Services.

2.7. Cookies And Other Technologies. We use these technologies to do things such as remember your preferences, keep you safe and improve and promote the Services. We track this information using cookies, or small text files, which include an anonymous unique identifier. Cookies are sent to a user’s browser from our servers and are stored on the user’s computer hard drive. Sending a cookie to a user’s browser enables us to collect Non-Personal information about that user and keep a record of the user’s preferences when utilizing our services, both on an individual and aggregate basis. For example, we may use cookies to collect data such as the time spent on our site or referral sites or pages.  We may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser.

 

3.    Sharing

As stated previously, we share some of your personal information with the family of the deceased to ensure they have been notified of your support.  Otherwise, when you use the Services, we may share your information only as described below:

3.1. Following The Law. We may disclose your information to third parties if we determine that such disclosure is reasonably necessary to comply with the law (including IRS regulations), protect our rights, or prevent fraud or abuse of IMO or our users. Should we receive law enforcement or national security requests for information, we strongly believe in privacy and transparency. We scrutinize such requests carefully and challenge vague, over broad or otherwise unlawful requests. And when legally permitted, we provide our users with notice that their information is being requested. This notice is provided so that you have the opportunity to challenge such requests.
 

4.    Protection

While no service is completely secure, we are dedicated to keeping your information safe. Our website employs security measures such as using firewalls to protect against intruders, building redundancies throughout the network (so that if one server goes down, another can cover for it) and testing for and protecting against network vulnerabilities. Payment information is transmitted using HTTPS encryption, and our site is maintained with a Level 1 PCI DSS certification.

 

5.    Retention

We'll retain your personal information for as long as we need it to provide our Services. We may retain your personal information in order to comply with the law, IRS regulations and statutes, protect our rights, resolve disputes or enforce our agreements.

 

6.  Links to Third Party Websites

As part of our Service, we may provide links to or compatibility with other websites or applications. This Privacy Policy applies solely to information collected by us through the IMO site and the Service and we are not responsible for the privacy practices employed by those websites or the information or content they contain. We encourage our users to be aware of when they leave our site and to read the privacy statements of other websites that may collect personal information before proceeding to use them.

 

7.    Modifications

We may modify this Privacy Policy from time to time, and will post the most current version on our site.
